For nearly 250 years, the Constitution has asserted that “we the people” are the actors shaping American law. Harvard Law School’s Nikolas Bowie and Daphna Renan, in conversation with law professor Kate Shaw, trace how this founding rhetoric became a foundational fallacy. Reflecting on the historical tension between the Supreme Court’s might and the individual Americans who have fought for different hierarchies of power, these legal scholars evaluate how one of the most central branches of our government has upended the central tenets of democracy.
Nikolas Bowie is the Louis D. Brandeis Professor of Law at Harvard Law School. Daphna Renan is the Peter B. Munroe and Mary J. Munroe Professor of Law at Harvard Law. Professors Bowie and Renan are co-authors of Supremacy: How Rule by the Court Replaced Government by the People.
Kate Shaw (moderator) is a law professor at the University of Pennsylvania Law School, the co-host of the podcast Strict Scrutiny, and a Supreme Court contributor for ABC News.
